    Rental at Goodwill Fees ng San jose
    “Legitimized Extortion”
    Itinuturing na isang “legitimized extortion” ang panukalang ordinansa ng bayan ng San Jose na naglalayong maningil ng rental at goodwill fees sa ilang commercial sites sa bayan, ayon sa isang komento mula sa Department of interior and Local Government.
    Batay sa dokumento na may petsang September 21, 2011 at nilagdaan ni Atty. Rolando B. Calabazaron, Regional Director ng DILG Region IV, ang Municipal Ordinance 764 s. 2011 ay isang “legitimized extortion.”
    Sinabi rin sa naturang komento ng DILG na “It qualifies as an ENFORFORCED DONATION as its imposition is not as a reasonable return of the cost of service or use of a property of the LGU (local government unit).” Idinagdag pa ng DILG na ito ay isang “legitimized extortion” na nagkukubli sa tawag na “Goodwill Fee or Option to Lease Fee.”
    Bukod dito, sinabi rin ng DILG na walang patunay na isinagawa ng munisipyo ang pagkunsulta sa publiko, isang rekesito sa pag-apruba ng isang ordinansa.
    “There is no proof of compliance to “Mandatory Public Hearing Prior to Enactment of any Ordinance with penal provision, Taxing and other revenue ordinance,” ayon sa DILG.
    Wala rin umanong legal na basehan ang naturang paniningil, ayon sa DILG.
    Ang panukalang singil ay P200,000, 50,000, 80,000 at mula P10,000 hanggang P150,000 kada metro kwadrado para sa iba’t-ibang pwesto sa Aroma Café, Aroma Beachwalk, Acacia Park at San Jose Commercial Complex. Ang San Jose Commercial Complex ay ang panukalang pagpapatayo ng bagong palengke.
    Maging ang pagbatid kung magkano ang mga halaga ng babayaran ay “arbitrary.” Sapat na umano ang “rental” bilang bayad sa paggamit ng pasilidad na pag-aari ng munisipyo. Ngunit maging ang pagbayad ng “rental” ay hindi sapat. Kailangan pa rin umano na magbayad ng “goodwill fee” para sa okupasyon ng pwesto.
    Ngunit ayon sa DILG, ang goodwill fee ay “inequitable, excessive, oppressive and confiscatory (di-patas, labis, nagpapahirap at nagkukumpiska). Wala rin namang pakinabang umano ang uupa dahil wala namang pakinabang na serbisyo bilang kapalit sa goodwill fee.
    Bagama’t lumalabas na magaan umano ang pagbayad ng !0% (ng goodwill fee) at babayaran ang putal sa loob ng 12 buwang installments, ito ay maituturing pa rin na “unlawful exaction” at sa bahagi ng LGU ay isang “unjust enrichment” (di makatarungang pagpapayaman).
    Samantala, maging ang Municipal Ordinance672 s. 2011 ay dir in umano dumaan sa pakikipag-konsultasyon sa publiko, isang rekesito na kapag hindi ginanap ay batayan para ideklarang invalid ang naturang panukalang batas habang nirerebisa ang balangkas na ito o di kaya naman ay sa korte.
    Gayundin, sinabi ng DILG na nilalabag nito ang Saligang Batas, partiikular ang “equal protection of laws clause” na idinesenyo para protektahan ang mamamayan laban sa anuman at lahat na pang-aabuso ng pamahalaan.

    CALLING THE ATTENTION OF THOSE WHO ARE CONCERNED,

    It has been a common practice in our local hospitals to refuse admission of patients in cases like they do not have enough equipment or doctor available to attend to the patient and advise for transfer instead, however, for the PINAMALAYAN COMMUNITY HOSPITAL to refuse admitting, or should we say at least have a look at a patient, with complaints of continuous vomiting, pale and have abdominal complaints, not because they do not have a doctor but because it is already 5 o’clock in the morning!!! Totally NOT acceptable don’t you think?? Somebody do something about this please! BAWAL YAN DI BA?!

    GOVERNOR UMALI, can you not take action regarding this matter?

    I have seen and experienced the denuding of the forests on and around mt. halcon. i have seen huge semi trucks leaving under the cover of darkness hauling out cargo that can only be logs and forest materials. i have seen the suffering that the rising rivers have caused. i have seen the dislocation and hardships the indigenous people have suffered because of mining and other exploitation. lets see how serious he law makers are about doing something about it.
    it has reached a tipping point now..

    The Aroma Beach must be improved and cleaned where tourists can enjoy the morning sun and watch gleefully the sunset at the western sky.

    Ilin and Ambulong Islands must be devloped into a pollution- free tourist spot to encourage our guests for them to bring their relatives and friends from within and outside the Philippines particularly the United States and the European countries, for them to breath the clean and unpolluted air from the green forest; to breath the sea-breeze from around the islands.

    Clean up the dirty bottom of the Pandurucan River especially at the back of the public market. Bring it back to where it was when years ago we swam and paddled our canoes up aks nd down the clean waters.

    Clean up and make it more sanitary the public market that stinks with garbage piles.

    For the other beaches other Aroma Beach, clean them up too; encourage parents not to let their children make these places a public toilet for tourists and beach hikers free from stepping into these human wastes!

    Encourage homeowners to clean their side in the street, restrain their pet animals go astray only to scatter their wastes!

    First of all, thank you for having this publication. I really enjoyed reading news items about Mindoro, though which I have been updated with everything that is going on. I can honestly say I am out of touch but with your help, I can update myself with news and happenings concentrated on Mindoro only.

    My name is Ben Baldoza, born in Pinamalayan. The last time I was there was in 1980. Now that I am retired, I intend to visit more. It is afterall, still my hometown.

      Read your messege at this site and I too from Pinamalayan, “Ramos family”,
      daughter of the late Joe Ramos (deseased 1988),. unfortunately not able to go home
      those days.

      We are at Quezon Street Zone III… near the Telecom tower.

      I myself been out of the country since 1974, and visited our Town 4 times since.

      I retired 2004, after 30 yrs overseas work (Europe),.. Now still healthy and kicking.

      Once met the Madrigal family at Las Vegas, the daughter of Dr Madrigal had a merienda
      at their house.

      I am currently a Californian ( Los Angeles).

    My name is Johan Groth and I am writing to you from Sweden. I have very strong ties to Mindoro because my wife is from Puerto Galera and because I worked in the scubadiving industry for six years on the island.

    I am trying to make people aware of the horrific plans to exploit the natural resurces of the island. I am born in the very north part of Sweden and we have examples of the destructive mining for nickel not so far from us. In the northeast part of Russia, only 400 km from my birthplace, you can find one of the most polluted places on earth. THIS CAN NOT BE ALLOWED ON THE ISLAND OF MINDORO.
